By completing the entry form on https://www.newzealand.com/au/campaign/great-autumn-road-trip-competition (the ‘TNZ Website’) and submitting the required information (‘Entry’), you (‘Entrant’) are entering the Tourism New Zealand Great Autumn Road Trip (the ‘ Competition’), confirming that you have read, understood and agree to all of these terms and conditions (‘Terms’), and meet the eligibility requirements.
The promoter of the Competition is the New Zealand Tourism Board trading as Tourism New Zealand (‘TNZ’, We), Level 1, 1 Nelson Street, Auckland, New Zealand. The Competition is being run in Partnership with Tourism Holdings Limited trading as Britz (Britz) . By submitting an Entry, the Entrant also accepts the Privacy Policy and Terms of Service on the TNZ Website (TNZ Website Terms).
The Competition will be conducted through the Competition page on the TNZ Website. TNZ reserves the right to cancel the Competition or change any of the Terms of the Competition (in any way it deems fit), without prior notice. We will announce any cancellation or modification to the Competition.
1 Entry Requirements
1.1 To enter the Competition, an Entrant must complete an Entry via the submission portal at https://www.newzealand.com/au/campaign/great-autumn-road-trip-competition between 7am AEST on 7 November 2022 and midnight on 4 December 2022 by:
a. submitting their top three destinations for their dream New Zealand Autumn road trip;
b. submitting their email address, name and state of residence;
c. signing up to the 100% Pure New Zealand mailing list;
d. completing any other required details on the submission portal; and
e. confirming acceptance of these Terms and the TNZ Website Terms.
1.2 Each Entrant may only submit one Entry.
1.3 Entries submitted by any means other than as set out at clause 1(a) of these Terms will be invalid and will not be accepted. If an Entrant fails to comply with any of the Terms, any Entry submitted will be void.
1.4 To submit a valid Entry, Entrants must:
a. be twenty-one (21) years of age or older as at the date of the Draw;
b. be an Australian resident who ordinarily resides in New South Wales, Victoria or Queensland
c. not be an employee or contractor (or an immediate family member of an employee or contractor) of TNZ or Britz.
1.5 If an Entrant does not provide accurate personal information in the Entry, TNZ may determine such Entry ineligible to participate in the Competition.
2 Competition Draw
2.1 The one (1) winner of the prize set out at clause 3.1 below (the ‘Prize Winner’) will be chosen by random draw by TNZ at 2 pm (NZT) on 5 December 2022 at TNZ at Level 1, 1 Nelson Street, Auckland, New Zealand 1010 (the ‘Draw’). TNZ will share the Prize Winner’s name and email address with Britz.
2.2 Britz will make every reasonable effort to contact the Prize Winner using the details provided to TNZ in their Entry form, within 72 hours of their Entry being drawn as a Prize Winner. To claim the Prize, the Prize Winner must, within 72 hours of Britz’ first attempted communication with the Prize Winner (the ‘Claim Period’), respond to Brtiz by sending an email confirming receipt of the communication to winners@thlonline.com. If the Prize is not claimed within the Claim Period, and Britz has made all reasonable inquiries to contact the Prize Winner and has been unsuccessful, the Prize Winner may be redetermined via another random draw by TNZ of the Entrants at TNZ at Level 1, 1 Nelson Street, Auckland, New Zealand 1010, after the Claim Period has ended.
2.3 Unsuccessful Entrants will not be contacted.
2.4 The Prize Winner agrees to be contacted by Britz for the purposes of arranging the supply of the Prize.
2.5 The Prize Winner’s last name and initial of the first name will be published at https://www.newzealand.com/au/campaign/great-autumn-road-trip-competition following completion of the Draw.
2.6 TNZ’s decision is final and no further correspondence will be entered into.
2.7 TNZ assumes no responsibility for any error, omission, interruption, deletion, defect, failure, malfunction, alteration, delay in delivery, operation or transmission, or other circumstance of any kind, which may affect an Entry or an Entrant’s participation in the Competition. TNZ reserves the right to verify the validity of any Entrant and Entry.
3.1 There is a total of one (1) prize to be won consisting of a voucher to redeem a 7-Day 2WD Britz Campervan Hire in New Zealand from Britz (the ‘Campervan Hire’) (valued at AUD$4,000) (the ‘ Prize’).
3.2 The Campervan Hire includes a fully equipped campervan, unlimited kilometres, THL Roadtrip Application and navigation system, and a liability reduction option (the ‘Britz Inclusive Pack’). Inclusions in the Britz Inclusive Pack can be found here: https://www.britz.com/nz/en/travel-info/whats-included.
3.3 The Britz Inclusive Pack comes with the ‘Liability Reduction Option’ level of insurance cover as detailed here: https://www.britz.com/nz/en/liability-reduction-popup . An alternative liability reduction option can be selected at the Prize Winner’s additional expense.
3.4 Exclusions:
a. Fuel costs are not included in the Prize;
b. Any applicable road user charges are not included in the Prize. The balance of any road user charges must be settled at the Britz branch upon return of the campervan.
c. All other expenses additional or incidental costs associated with receiving and using the Prize, including flights to and from New Zealand are the sole responsibility of the Prize Winner
3.5 The Prize is valid for twelve (12) months from the date of issue to the Prize Winner and no compensation will be payable if a Prize Winner is unable to use the Prize within this period. No part of the Prize can be transferred, exchanged, retained as credit, or redeemed for cash. TNZ and Britz are not responsible for any use of the Prize, including without limitation availability, any cancellation, delay or rescheduling, and any costs incurred as a result (including, without limitation, travel, and accommodation costs) will be the sole responsibility of the Prize Winner.
3.6 To redeem the Prize and confirm their booking, the Prize Winner must:
a. provide to Britz details of the Prize Winner’s preferred vehicle type, dates of travel, pick-up/drop-off locations in New Zealand (either Auckland, Christchurch, or Queenstown) and the voucher number;
b. agree to the Privacy Policy and Terms and Conditions on Britz’ Website (Britz Website Terms), and the Britz Rental Agreement Terms and Conditions (available here:https://www.britz.com/nz/en/terms-and-conditions) ( Britz Rental Terms).
3.7 The Prize Winner may add extra rental days to the Prize at their own expense. The Britz Inclusive Pack (including the Liability Reduction Option) will apply to the additional days. An alternative liability reduction option for these extra days cannot be selected.
3.8 The driver of the campervan must be over 21 years of age with a full driver’s licence held for at least one year. If the driver holds a foreign driver’s licence issued in a language other than English it must be accompanied by a current international driving permit issued in the same country as the driver’s licence was issued.
3.9 The Prize may not be passed on or gifted for the benefit of anyone else other than the Prize Winner and any additional persons accompanying the Prize Winner (‘Travellers’). Any Travellers must also agree to these Terms (where applicable to them) as a condition of using the Prize. If required by TNZ, Britz, or any other supplier of the Prize (‘ Supplier’), a Traveller must sign any further terms and conditions, agreement, or acknowledgement, including (but not limited to) a code of conduct.
3.10 The Prize is provided by Britz and the Campervan Hire will be subject to the Britz Website Terms and Britz Rental Agreement. Availability of the Prize is subject to Britz’ vehicle availability and branch opening hours and dates. Availability may be limited at certain times due to special events held in New Zealand. The Prize cannot be redeemed during the following periods:
a. Christmas/New Year: 15 December to 15 January;
b. School holidays:
i 3 April 2023 to 23 April 2023
ii 23 June 2023 to 16 July 2023
iii 22 September 2023 to 8 October 2023
4 Governing Law, Limitation of Warranties and Liability
4.1 The Competition and these Terms shall be governed by the laws of Australia. To the maximum extent permitted by law, TNZ and Britz (and their associated entities, employees, contractors, and agents):
a. disclaim all guarantees, warranties, and representations of any kind in respect of the Competition, the Prize, and the claiming and use of the Prize;
b. exclude any and all liability for any loss (including damage, claim, injury, cost, or expense) which is suffered or incurred by an Entrant in connection with the Competition or the Prize; and
c. will not be responsible for any events beyond their reasonable control, such as unforeseen closures or restrictions due to natural disasters, unexpected weather conditions, COVID-19 or any other pandemic. To the extent an event beyond the reasonable control of TNZ or a Supplier occurs, the timetable for this Competition, Prize, and related promotions may be modified by TNZ.
5 Privacy
5.1 The collection, use and disclosure of personal information provided in connection with the Competition is governed by TNZ’s privacy policy (found here: https://www.newzealand.com/nz/utilities/privacy-policy/).
5.2 We may use your personal information for any purpose which is stated to you at the time of collection or that you otherwise authorise and to:
a. store the information in any database controlled by TNZ.
b. verify your identity and to assist you if you forget your username or password for any of the services we provide to you via the Internet;
c. communicate with you;
d. analyse usage of this website;
e. provide you with further information, news, and promotional material;
f. carry out marketing, promotional and publicity purposes including direct marketing, market research and surveys;
g. to show you advertising and information that is most relevant to you and your interests; and
h. improve the content of this website and to customise this website to your preferences.
5.3 We will not sell, rent, or lease your personal information to third parties. Your personal information will be made available internally for the above purposes and we may also disclose your personal information to trusted third parties or subcontractors, who have agreed to treat your personal information in accordance with this privacy policy, for similar purposes. Because we operate internationally, the recipients referred to above may be located outside the jurisdiction in which you are located. Your personal information may be transferred to, stored, and processed in New Zealand and other countries that are regarded as ensuring an adequate level of protection for personal information.
5.4 We will only use or disclose personal information that you have provided to us, or which we have obtained about you for the above-mentioned purposes, or:
a. if you have authorised us to do so;
b. if we believe that the use or disclosure is reasonably necessary to assist a law enforcement agency or an agency responsible for national security in the performance of their functions;
c. if we believe that the use or disclosure is reasonably necessary to enforce any legal rights we may have, or is reasonably necessary to protect the rights, property and safety of us, our customers, or others; or
d. if we are authorised, required or permitted by law to disclose the information.
5.5 You may have rights of access to and correction of your personal information under the Privacy Act 2020. You may request access to, or correction of, their information by writing to TNZ at Level 1, 1 Nelson Street, Auckland, New Zealand 1010 or emailing stephanie.cornwall@tnz.govt.nz.
5.6 The Prize Winner’s name and email address will be provided to Britz for the purpose of Britz contacting the Prize Winner and to arrange delivery of the Prize.
6 Commercial electronic messages
6.1 By completing an Entry, you consent to receive commercial electronic messages marketing and promoting goods and services of TNZ such as emails from TNZ including 100% Pure New Zealand emails. You also consent to receiving any electronic messages containing updated information in relation to TNZ’s news and various other information of related interest. You may unsubscribe at any time to receiving such messages by following the unsubscribe process specified in any such electronic message that you receive.
